Introduction
Bengamu Tech Ltd ("Company", "we", "us", or "our") operates Kenol Marketplace (the "Platform"), a digital agricultural marketplace connecting farmers and suppliers with buyers across Kenya. This Privacy Policy describes how we handle personal data belonging to Users of the Platform and is incorporated by reference into our Terms and Conditions.
We are committed to processing personal data lawfully, fairly, and transparently, in accordance with the Kenya Data Protection Act, 2019 and its subsidiary regulations.
Information We Collect
We collect the following categories of information when you register for and use the Platform:
| Identity data | Full name, phone number, and, for Suppliers, business name and registration details. |
| Location data | Delivery addresses and, where permitted, device location, used to match Buyers with nearby Suppliers and Delivery Partners. |
| Transaction data | Order history, listing activity, M-Pesa payment references, and commission records. |
| Communication data | Messages exchanged through the Platform, and correspondence with our support team. |
| Technical data | Device type, app version, and usage analytics collected to maintain and improve the Platform. |
How We Use Your Information
- To create and manage your Account and verify your identity.
- To process Orders, payments, and Escrow Period holdings.
- To coordinate delivery logistics with Delivery Partners.
- To provide customer support and resolve disputes.
- To send important notices about your Account, Orders, or changes to these policies.
- To detect, prevent, and investigate fraud, abuse, or violations of our Terms.
- To improve the Platform's features, performance, and reliability.
Sharing of Information
We share personal data only where necessary to operate the Platform:
- With Suppliers and Buyers, limited to the information needed to complete a Transaction (e.g. delivery address, contact number).
- With Delivery Partners, to enable order fulfilment.
- With Safaricom M-Pesa, to process payments.
- With service providers who support our infrastructure (hosting, analytics, customer support tools), under confidentiality obligations.
- With regulators or law enforcement where required by Kenyan law.
We do not sell your personal data to third parties.
Data Retention
We retain personal data for as long as your Account remains active, and for a reasonable period afterward to comply with legal, accounting, or dispute-resolution obligations. You may request deletion of your data at any time, subject to Section 6 below.
Your Rights
Under the Kenya Data Protection Act, 2019, you have the right to:
- Access the personal data we hold about you.
- Request correction of inaccurate or incomplete data.
- Request deletion of your data, subject to legal retention requirements.
- Object to or restrict certain processing of your data.
- Lodge a complaint with the Office of the Data Protection Commissioner (ODPC) of Kenya.

Data Security
We apply reasonable technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
